Terms of service

These terms apply to your use of obitec.ai and to services provided by ObiTec LLC (“Obitec”, “we”, “us”). For any project, the written quote or proposal we send you is part of the agreement. If it conflicts with these terms, the quote or proposal wins.

Using this website

This website is provided for information. It is provided “as is”, and we don’t promise it will always be available or free of errors. Please don’t misuse the site, try to break or overload it, or send us anything unlawful. The interactive demos use made-up data and are examples only.

Our services

We build chatbots, workflow automations, dashboards, custom software tools, websites, store setups, app screen designs, logos and related digital work. Each project’s scope, price, timeline, deliverables and number of revisions are set out in a written quote before work starts. Work outside that scope is quoted separately.

Payment

Payment terms are stated in the quote. Unless it says otherwise, a deposit is due before work begins and the balance is due on delivery. Prices are in US dollars. Subscriptions and licences for third-party tools and services (such as Zapier, Make, n8n, Supabase, Shopify themes or apps, domain names, hosting or AI providers) are your responsibility and are billed to you directly.

What we need from you

To do the work, we may need access to accounts, content and information. You agree to provide what we reasonably ask for, to keep it accurate, and to confirm you have the right to share it, including any images, logos, text and customer data. Delays in getting what we need can move the delivery date.

Your legal duties as the owner of the tool

You are responsible for how you use what we build for your business. For example, if a chatbot, form or automation collects information from your customers, you are responsible for having the privacy notices, consents and email-marketing practices that the laws applying to your business require.

Software projects

Custom tools and apps are usually built on third-party platforms, such as Lovable, Supabase and Stripe. Those platforms have their own terms, prices and availability, which we don’t control. Unless the quote says otherwise, you receive access to the finished project and its source code once you have paid in full.

Ownership

When you have paid in full, you own the deliverables made specifically for you. We keep ownership of our pre-existing tools, templates and know-how, and give you a licence to use them as part of your deliverables. Unless you ask us not to, we may describe the project in general terms in our portfolio, without sharing confidential information.

Confidentiality

We keep your non-public business information confidential and use it only to do the work. This doesn’t apply to information that is already public or that we are legally required to disclose.

AI and automation limits

AI tools can make mistakes. We test what we build, but we can’t promise that AI-generated output will always be accurate or suitable, or that third-party tools will always be available. You are responsible for reviewing important output before relying on it. We make no promise of specific business results, such as sales, rankings or savings.

Fixes after delivery

Unless your quote says otherwise, we fix bugs and make small corrections to what we delivered for 14 days after handover at no charge. Changes to third-party tools or to your own systems after that may need a care plan or a new quote.

Limit of liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, such as lost profit or lost data. Our total liability for any project is limited to the fees you paid us for that project. Nothing in these terms limits liability that can’t be limited by law.

Ending a project

Either of us can end a project by written notice. You will pay for work completed up to that point, and we will hand over completed work once payment is made.

Governing law

The law and the place for resolving disputes will be stated in your written quote or proposal. We will always try to settle any disagreement with you directly first.
